Terms of use for FluxoKit's English market surface and planned subscription launch.
1. Acceptance
By accessing or using FluxoKit, you agree to these Terms. If you do not agree, do not use the service.
Paid checkout is live. FluxoKit accepts paid subscriptions billed in U.S. dollars through Stripe, and these policies govern that paid checkout.
2. Operator and billing entity
FluxoKit is operated by FluxoKit Servicos LTDA, and paid checkout is processed through FluxoKit, LLC using Stripe.
Paid checkout identifies the operating entity, the plan, and the governing terms at the time of purchase.
3. Service
FluxoKit is a visual AI workspace for workflows that use image, video, text, and creative tools from multiple providers. Provider availability, model parameters, limits, pricing inputs, and output behavior can change as underlying services change.
You are responsible for prompts, uploads, references, and other content you submit. Do not submit illegal content, private material you are not allowed to use, or content that violates provider rules.
4. Accounts and credits
You are responsible for activity in your account and for keeping account access secure. Generations may consume credits based on the selected model, settings, and provider cost profile.
Credits are a usage measurement inside FluxoKit. They are not cash, stored value, gift cards, banked funds, or transferable property.
5. Stripe billing
Subscriptions are billed in U.S. dollars through Stripe. Checkout shows the plan, renewal cadence, currency, price, credit allocation, cancellation method, and refund policy before payment is collected. Any applicable taxes are added by Stripe at checkout where FluxoKit is required to collect them.
Subscriptions renew automatically unless cancelled before the next billing date. Renewal terms, billing period, and price are presented clearly before checkout completion.
Stripe provides hosted Checkout, invoices, receipts, payment method management, tax calculation, fraud controls, and the Customer Portal. FluxoKit does not store full card numbers.
- Paid checkout is active and billed in U.S. dollars through Stripe.
- No subscription charge is created before express checkout consent.
- Stripe webhook events must be verified and reconciled before local entitlement or credit state is trusted.
- Payment creation, refunds, and subscription updates should use idempotency controls.
6. Cancellation and renewal notices
Customers can cancel through the Stripe Customer Portal or another clear support path. Because online checkout is used, online cancellation is available without unnecessary delay or obstruction.
Cancellation normally stops future renewals and preserves access through the paid billing period unless the checkout or support confirmation states otherwise. Material price or subscription changes will be communicated before they take effect where required.
7. Refunds and service credits
The launch refund policy is published separately and is incorporated into these Terms. Provider or system failures may restore FluxoKit credits without creating a cash refund.
Cash refunds, when approved, are expected to be processed through Stripe back to the original payment method unless another lawful method is required.
8. Third-party providers
FluxoKit integrates third-party AI, hosting, database, storage, analytics, payment, and support providers. Their terms, safety policies, outages, rate limits, or model changes may affect service behavior.
You may not use FluxoKit to violate law, third-party rights, provider policies, platform safety rules, or payment network rules.
9. Privacy
The Privacy Policy explains how FluxoKit handles account, usage, generation, support, analytics, and billing-related data. By using FluxoKit, you acknowledge that data may be processed by service providers needed to operate the platform.
10. Disclaimers and limitation of liability
The service is provided as is and as available. To the fullest extent allowed by law, FluxoKit is not liable for indirect, incidental, special, consequential, or punitive damages from use of the service.
To the fullest extent allowed by law, total liability is limited to the amount paid to FluxoKit for the service in the previous 12 months.
11. AI content, ownership, and training
You keep ownership of the prompts, images, and other inputs you submit. As between you and FluxoKit, and to the extent permitted by applicable law and the relevant model provider's terms, you own the outputs you generate and may use them for personal and commercial purposes, consistent with the commercial-use rights described in your plan. You are responsible for ensuring your inputs and your use of outputs do not infringe third-party rights or violate provider rules.
FluxoKit is a multi-provider workspace: your inputs and outputs are processed by the third-party AI model providers you select, and those providers handle that content under their own terms, which may include using submitted content to operate or improve their models. FluxoKit does not use your private inputs or outputs to train its own foundation models. Because AI outputs may resemble outputs generated for others and may not be protectable under intellectual-property law, FluxoKit does not warrant that any output is unique or eligible for IP protection.
12. Governing law and dispute resolution
These Terms and any dispute arising out of or relating to them or the service are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where the mandatory consumer-protection law of your home jurisdiction applies.
Before filing any claim, you and FluxoKit agree to first try to resolve the dispute informally by contacting the other party and allowing at least 30 days to reach a resolution. Subject to any mandatory venue your local law provides, the state and federal courts located in Delaware have jurisdiction over disputes that are not resolved informally.
13. Eligibility
You must be at least 18 years old and able to form a binding contract to purchase a paid, auto-renewing subscription. The service is not directed to children, and you must be at least 13 years old to create an account. FluxoKit does not knowingly collect personal information from children under 13 without verifiable parental consent; if you believe a child under 13 has provided personal information, contact us and we will delete it.
14. Acceptable use
You agree not to use the service to create or distribute unlawful content, including child sexual abuse material, non-consensual intimate imagery, content that impersonates a real person in order to deceive, infringing content, malware, or content that violates a third party's rights or a model provider's usage policy. You are responsible for your inputs and outputs. FluxoKit may suspend or terminate accounts that violate this policy or applicable provider rules.
15. Copyright and DMCA
FluxoKit respects intellectual-property rights. If you believe content available through the service infringes your copyright, send a notice with the information required by the U.S. Digital Millennium Copyright Act (17 U.S.C. 512) to contato@fluxokit.io, including identification of the work, the material at issue, your contact details, a good-faith statement, and your signature. We respond to valid notices, may remove infringing material, and may terminate repeat infringers.
16. Changes to these Terms
We may update these Terms from time to time. For material changes that affect your rights or the paid service, we provide notice by email or in the product before the change takes effect. Continued use of the service after a change becomes effective constitutes acceptance of the updated Terms.
